Sign-Up & Trial Notice
  • Partner Data Sharing: By signing up on faronicscloud.com, you consent to Faronics sharing your evaluation details with an Authorized Faronics Partner serving your specific country or region so that they may assist with your trial deployment and software evaluation.
  • No Obligation Trial: Free 30-day trial sign-ups do not require credit card or payment details and will not automatically convert into paid subscriptions.

Part 1: Deep Freeze Cloud Terms of Service

1. Definitions

  • Account: The account created and maintained in the Infrastructure for the Subscriber to access Services.
  • Content: Reference content as defined in Section 4.3.
  • Deep Freeze Cloud Services: Web-based software provided by Faronics as a service, including Deep Freeze, Anti-Executable, Anti-Virus, WINSelect, Power Save, and other cloud product offerings.
  • Device: Desktop computers, workstations, servers, or Windows/Mac/mobile devices on which software is installed or used.
  • Infrastructure: Hardware systems, software, and data centers owned or leased by Faronics or its third-party providers.
  • Order: A subscription order placed by the Subscriber or through an authorized Faronics reseller.
  • Privacy Laws: Applicable legislation regarding personal data protection, including GDPR (Regulation 2016/679), UK-GDPR, CCPA/CPRA, PIPEDA, and applicable provincial or state privacy statutes.
  • Services: Access to Deep Freeze Cloud services and software, including updates, modifications, and online documentation.
  • Software: Client software downloadable by the Subscriber to access or deliver Services.
  • Subscriber: The individual or legal entity requesting or subscribing to the Services.

2. Modifications to this Agreement

Faronics reserves the right to modify these terms at any time. Updated versions will be posted at www.faronicscloud.com. Continued use of the Services following modifications constitutes acceptance of the revised Terms.

3. Use & Subscriptions

  • 3.1 Grant of License: Subject to the payment of applicable subscription fees, Faronics grants a non-exclusive, non-transferable, revocable license during the Subscription Period to access and use the Services for internal business operations.
  • 3.2 Authorized Users: Access is restricted to authorized users. Subscriber is strictly responsible for maintaining credentials and account security.
  • 3.3 Renewal: Subscriptions automatically renew per the terms specified in the Order unless cancelled according to agreement procedures.
  • 3.4 Updates: Faronics may push updates, patches, or modifications to the Software to maintain security, stability, and functionality.

4. Access, Support & Updates

  • 4.1 Account Access: Subscriber must create an account with a strong username and password to access the Cloud Console.
  • 4.2 Support Services: Technical support is available during regular business hours via web, email, or phone as outlined at www.faronicscloud.com.
  • 4.3 Software & Content Updates: Software updates and feature definitions may be pushed automatically or require manual deployment through the console interface.

5. Privacy, Regional Partners & End User Consent

  • 5.1 Privacy Policy: General privacy practices are detailed in our Privacy Policy accessible at www.faronicscloud.com/legal/privacy.
  • 5.2 Regional Partner Consent: By signing up or registering for an evaluation on www.faronicscloud.com, you consent to Faronics sharing your contact and evaluation details with an Authorized Faronics Partner serving your specific country or region to assist with software setup and evaluation.
  • 5.3 Responsibility for End User Consent: Although Faronics software collects system and device data, Faronics does not directly interact with end users (who are the customers or users of Faronics' customers). The software is deployed and managed by Faronics at the customerโ€™s request. It is strictly the customerโ€™s legal responsibility to ensure they have proper consent to collect data from end users.
  • 5.4 Data Processing Roles: Under applicable Privacy Laws (including GDPR), the Subscriber acts as the Data Controller, and Faronics acts as the Data Processor. Data is processed in accordance with our Data Processing Addendum (DPA) available at www.faronicscloud.com/legal/dpa.
  • 5.5 Security Responsibilities: Subscribers are responsible for securing account credentials. Faronics must be notified immediately at legal@faronics.com of any suspected breach or unauthorized access.

6. Subscriber Conduct & Prohibited Uses

Subscribers shall not:

  1. Reverse engineer, decompile, or attempt to derive source code from the Software or Services.
  2. Rent, lease, resell, host, or sublicense the Services to unauthorized third parties.
  3. Use the Services to transmit malware, spam, viruses, or unlawful material.
  4. Interfere with or disrupt the integrity or performance of Faronics infrastructure or data.
  5. Bypass access controls, authorization measures, or security mechanisms.

7. Evaluations, Free 30-Day Trials & International Privacy Rights

  • 7.1 Free Trial Terms: Faronics may offer free evaluation trials (typically up to 30 days). Free trials on www.faronicscloud.com do not require credit card or payment information and do not automatically convert into paid subscriptions upon expiration. Trial versions are provided โ€œAS ISโ€ without warranties or indemnities.
  • 7.2 Lawful Basis for Trial Processing: When you register for a trial, Faronics processes your personal contact information (e.g., name, business email, company name) on the legal basis of taking steps at your request prior to entering into a contract (Article 6(1)(b) GDPR) and to deliver requested trial access.
  • 7.3 Purpose-Bound Partner Sharing: Personal information collected during trial sign-up is shared with Authorized Faronics Regional Partners strictly for assisting you with setup, local support, and technical evaluation of the software.
  • 7.4 Data Subject Rights (GDPR / CCPA / PIPEDA): Trial users retain full rights under applicable data protection laws. You have the right to:
    • Request access to or a copy of your personal data collected during trial sign-up.
    • Request correction of inaccurate personal data.
    • Request immediate deletion ("Right to be Forgotten") of your trial account and associated personal data prior to or after expiration.
    • Object to or restrict processing of your personal data.
    To exercise any of these rights, submit a formal request to privacy@faronicscloud.com or dpo@faronicscloud.com.
  • 7.5 International Data Transfers: Data collected during sign-up may be transferred to and stored on secure cloud infrastructure in Canada, the United States, or the EU. Transfers from the EU or UK are protected under adequacy decisions or Standard Contractual Clauses (SCCs).

8. Intellectual Property Rights

All title, ownership rights, trademarks, and intellectual property rights in and to the Services, Cloud Console, and Software belong exclusively to Faronics Corporation and its licensors.

9. Third-Party Software Components

Certain features or software modules integrated into Faronics products may be subject to third-party open-source or proprietary licenses. Third-party components are governed by their respective license terms.

10. Disclaimer of Warranties & Limitation of Liability

  • 10.1 NO WARRANTY: SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR UNINTERRUPTED OPERATION.
  • 10.2 LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, FARONICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION). TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY SUBSCRIBER IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

Faronics may suspend or terminate access if Subscriber breaches any material provision of this Agreement. Upon termination, Subscriber must cease all use of Services and immediately uninstall all client Software from managed devices.

12. General Provisions

  • 12.1 Governing Law: Governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

Part 2: Cloud Product Data & Privacy Transparency

Overview

When you use Faronics products, you entrust us with data regarding your system and your systemโ€™s users. We recognize that your privacy and security are valuable, and we use your data only to provide and improve our services. We store data on secure servers and erase it when you no longer require our services.

Category Policy / Information
Privacy & Advertising Faronics respects your privacy. System, customer, and end-user data are never used to create targeted advertisements.
Evaluation Data Sharing When registering for a trial, contact information is shared strictly with Authorized Faronics Partners in your region to assist with setup and technical evaluation.
Why Data is Collected Data enables remote monitoring, command execution, system state maintenance, vulnerability patching, software deployment, and continuous feature improvement.
Data Processing Roles Faronics acts as the Data Processor. Data is processed and stored on secure cloud servers pursuant to customer instructions and our Data Processing Addendum (DPA). Customers retain access to raw/processed data and can export select data types.
Data Retention Period Data is retained as long as necessary to deliver services. Following account termination, data is typically deleted within 12 months to 2 years to allow customers sufficient time to safely remove cloud agents from their environments. Earlier deletion may be formally requested.
Third-Party Tools (UserVoice) UserVoice is an integrated feedback tool in the Deep Freeze Cloud Console. It does not collect data until a user voluntarily submits feedback. UserVoice accounts and data are erased upon account deletion or request.
